Lexy Care+ Extended Warranty Service Terms and Conditions

Lexy Care+ Extended Warranty Service(Hong Kong and Macau) Terms and Conditions 

This Agreement

This Agreement for the Lexy Care+ Extended Warranty Service in Hong Kong and Macau (“this Agreement”) provides replacement services for your product (“Product”) during the extended warranty period (“Extended Warranty Period”) after the original manufacturer’s warranty has expired, subject to the terms and conditions herein. “We,” “us,” or “our” refers to Lexy, and “you” or “your” refers to the purchaser of this Agreement. This warranty service extends the original manufacturer’s warranty, covering mechanical and electrical failures of the Product, provided it is used solely in Hong Kong and Macau for domestic and personal purposes. Non-compliance will render this Agreement void.

This Agreement applies to brand-new products purchased from Lexy and must be acquired within thirty (30) days of the Product purchase or as part of Lexy membership tiers (Gold, Silver, or Bronze) in the same year. The Agreement term is capped at twelve (12) months, or for membership-acquired Agreements: Gold Tier – up to twelve (12) months, Silver Tier – up to six (6) months, Bronze Tier – up to three (3) months, as indicated on the original invoice issued by Lexy. If the Product is replaced under the “Lexy Return Policy” or has been refunded or canceled, this Agreement becomes void, and Lexy will issue a new Agreement for the replacement Product. For details of the “Lexy Return Policy,” visit www.lexy.com.hk under the Returns Policy and Terms section. This Agreement is a service contract and does not constitute a guarantee or promise regarding the Product’s material quality, craftsmanship, or performance.

Products with Original Manufacturer’s Warranty

The warranty period for a Product can be found on the product page, calculated from the order confirmation date.
The original manufacturer’s warranty must not exceed six (6) years.
Certain brands and product categories are handled directly by the manufacturer for replacements and warranties, and are not covered by this Agreement, including but not limited to HOT OCTOPUSS and customized products.

After the Original Manufacturer’s Warranty Expires

If the Product experiences mechanical or electrical failure during the Extended Warranty Period, submit a request at Return and Warranty Page. Lexy’s dedicated representative will review the information and inspect the Product to determine eligibility for replacement. Upon confirmation and surrender of the faulty Product, Lexy will provide a brand-new replacement Product (“Replacement Product”).

Ensure all data in the original Product is backed up and deleted (if applicable), as Lexy is not responsible for any data loss during replacement.
Once the Product is replaced under this Agreement, the Agreement terminates automatically, and the faulty Product becomes Lexy’s property.

Replacement:
(a) During the Extended Warranty Period, Lexy will replace the Product with an identical or comparable model, quality, and functionality, at Lexy’s discretion. If the Product is out of stock or discontinued, Lexy may provide the same model in a different color/style or issue an electronic gift card, at Lexy’s discretion.
The value of the store credit is capped at 30% of the original Product’s purchase price (“Replacement Value”).

Liability

Under no circumstances will the warranty coverage extend to any loss of profit, incidental, consequential, special, or indirect losses, or any losses arising from delays in services provided under this Agreement, including but not limited to personal or property damage.

Exclusions from Warranty Coverage

The following are not covered by this Agreement:

  • Products with an original manufacturer’s warranty exceeding six (6) years.
  • Products still under original manufacturer’s warranty, repair warranty, or other active warranty plans.
  • Defects or flaws subject to manufacturer recalls.
  • Unauthorized modifications, improper installation, use, or maintenance contrary to manufacturer instructions, or issues not affecting the Product’s core functionality.
  • Consumable products.
  • Damage from external factors, such as incorrect wiring, power connections, signal adjustments, or consequential losses.
  • Damage due to accidents, human error, theft, liquid leakage, corrosion, animals, insects, “fungus,” natural wear, or gradual deterioration (e.g., humidity, oxidation). “Fungus” includes all forms of mold, mildew, mycotoxins, spores, odors, vapors, gases, or substances produced or released by fungi.
  • On-site services, repairs, or defects not covered by the manufacturer during the original warranty period.
  • Shipping, delivery, courier fees, or damage incurred during transportation.
  • Products leased, used for profit, or resold to retail stores.
  • Discounted products, including but not limited to flash sales, OUTLET items, or defective products.
  • Products not purchased from Lexy.

Record Keeping

While Lexy maintains records of this Agreement, please retain your copy for reference.

General

Lexy’s Terms of Service and Privacy Policy are incorporated into this Agreement by reference.
These Terms and Conditions were updated on September 27, 2024. In case of disputes, the Traditional Chinese version prevails, and Lexy reserves the final decision.
